A sport company called 90 plus that manufactures sport apparels is preparing to sue Extension Gunners for what they believe to be a contract breach. The company is said to have penned a one year deal with Gunners to manufacture and dress Lobatse based club.
However, it is said that the trouble ridden club has terminated the contract but the supplier is seeking compensation. It is claimed that the company wants to seek legal redress upon realization that the contract was abruptly ended without proper consultation. The company is directed by one Simon Maposa, the brother of former Mochudi Center Chiefs shot stopper Noah Maposa and has Botswana’s finest midfield Dirang Moloi as its local agent. Moloi is currently on the books of this Gunners team as a player.
It is further claimed that the sportswear company is disappointed by the manner in which Gunners addressed the matter. 90 plus is said to be shocked at the developments undertaken by a club smashed by identity crisis. The company is insistent that they had ordered enough material to cut and design for the club basing on the duration of the contract. They say the club’s move to terminate will now mean that their orders are surplus to requirement. It is why they find it fit to claim damages from the contract that has been terminated.
The damages, as quantified through monetary terms are not yet clear, but it is estimated to be above 100 000 Pula. Maposa, when approached for further details refused to shed light on the matter. “I cannot talk contractual matters with third parties. It is best you go back to that person who informed you to tell you more, I only need business and that’s all,” he said.
Gunners, a club wrong footed by internal factions is curiously led by two warring groups. It is why all attempts to reach Tariq Babitseng proved futile as his phone went unanswered. Babitseng who was voted as the club Chairman, is believed to be the person who spearheaded the termination of the deal. There is no doubt that the club is battling militancy and back biting after one splinter group emerged and claimed to have voted out the previous committee.
However, the old committee has stood defiant against these past proceedings and has written to the Association asking for recognition. The committee has even assured the BFA that they have submitted annual returns to the Registrar of Societies and the receipt of acknowledgement shall be forward to the Association as a living proof. According to the old committee, this receipt will act as an assurance ticket that indeed the Registrar of Societies recognizes them as a bona-fide group which is mandated to run and administer the club.
The new committee on the other hand remains steadfast that a constitutional meeting was held to kick out the old lot and this was executed through a properly propagated motion of no confidence. Gunners does not only fight on the field of play to remain relevant, they are also battling a serious war of debts that has left former players and coaches aggrieved.
